Affiliate Program Terms and Conditions

1. Relationship Between the Parties

This Affiliate Agreement ("Agreement") defines the terms and conditions of the affiliate partnership between:

Affiliate: The individual or entity that has enrolled in the Pinpasta Affiliate Program.

2. Enrolment Options

Affiliates may join the program through one of the following methods:

  1. Full Application: Complete the detailed affiliate application form.
  2. Checkbox Agreement: For existing customers, agree to these terms when prompted in your account settings.

Both methods constitute full acceptance of these Affiliate Terms and Conditions.

3. Independent Contractor Status

The Affiliate is an independent contractor, not an employee, agent, partner, or joint venturer of HEHE.studio Labs. The Affiliate has no authority to bind HEHE.studio Labs or Pinpasta to any agreement or commitment.

4. Application and Enrollment Process

4.1. Prerequisites

Before joining the Pinpasta Affiliate Program, you must first be approved by Lemon Squeezy:

  1. Create Account: Sign up at affiliates.lemonsqueezy.com.
  2. Submit Application: Complete Lemon Squeezy's affiliate application.
  3. Await Approval: Lemon Squeezy reviews and vets every new applicant.
  4. Get Approved: Once approved, you gain access to the affiliate platform.

4.2. Joining Pinpasta's Program

  1. Find Our Program: Search for "HEHE.studio Labs" in the programs list, or use the direct link after approval.
  2. Choose Enrollment Method:
    1. Option A: Complete the full application form.
    2. Option B: For existing customers, use checkbox enrollment in account settings.
  3. Receive Your Links: Upon acceptance, you'll receive:
    1. Standard link: hehelabs.lemonsqueezy.com/?aff=YOUR_CODE
    2. Short link: pinpasta.hehe.studio/?aff=YOUR_CODE

Important Notes: You must be approved by Lemon Squeezy before applying to our program. Both enrollment methods (full application or checkbox) have equal standing. Your affiliate code is unique and must not be shared. All tracking and payments are managed through the Lemon Squeezy platform.

5. Commission Structure

  • Commission Rate: 15% of the initial purchase price (excluding taxes).
  • Recurring Commissions: None — commissions are paid only on initial purchases.
  • Refund Policy: Commissions are subject to reversal if a customer requests a refund.
  • Payment Schedule: Monthly, within 30 days after month end.
  • Minimum Payout: €10 (or equivalent).

6. Cookie Duration

Our affiliate tracking cookies remain active for 30 days from the initial click. If a referred customer makes a purchase within this window, the commission is attributed to the referring affiliate.

7. Affiliate Links and Tracking

  • Affiliates will receive unique tracking links through our affiliate platform.
  • Links must not be modified or obscured.
  • Proper attribution requires users to click through affiliate links.
  • Direct link sharing is encouraged; link cloaking is prohibited.

8. Payment Terms

  • Payments are processed via our affiliate platform (currently Lemon Squeezy).
  • Affiliates are responsible for providing accurate payment information.
  • Affiliates are responsible for all applicable taxes on commission earnings.
  • HEHE.studio Labs reserves the right to withhold payment for fraudulent or suspicious activity.

9. Permitted Promotional Methods

Affiliates may promote Pinpasta through:

  • Personal websites and blogs
  • Social media platforms
  • Email marketing (to opted-in subscribers only)
  • Video content and tutorials
  • Educational content and courses

10. Prohibited Activities

  • Use spam or unsolicited emails
  • Make false or misleading claims about Pinpasta
  • Use Pinpasta or HEHE.studio trademarks without permission
  • Create websites that could be confused with official Pinpasta properties
  • Use cookie stuffing or other deceptive practices
  • Promote on coupon, deal, or discount sites without prior approval

11. Brand Bidding Restrictions

Strictly Prohibited:

  • Bidding on "Pinpasta" or variations (e.g., "PinPasta", "Pin-pasta")
  • Using Pinpasta or HEHE.studio trademarks in ad copy or display URLs
  • Creating ads that appear to be from Pinpasta directly

Violation of brand bidding terms results in immediate termination and forfeiture of pending commissions.

12. Content Standards

  • Professional and appropriate
  • Truthful and not misleading
  • Compliant with FTC disclosure requirements
  • Free from offensive or discriminatory material
  • Respectful of intellectual property rights

13. Marketing Restrictions

13.1. Prohibited Promotional Methods

  • Search engine ads on branded terms
  • Pop-ups, pop-unders, or similar intrusive formats
  • Incentivized clicks or forced redirects
  • Promotion alongside illegal or inappropriate content
  • False scarcity or urgency tactics

13.2. Content Guidelines

  • Be truthful and not misleading
  • Comply with FTC disclosure requirements
  • Do not make unauthorized claims about Pinpasta features
  • Respect our brand guidelines (available upon request)
  • Adhere to our Usage Guidelines document

14. Disclosure Requirements

Affiliates must clearly disclose their relationship with HEHE.studio Labs/Pinpasta in accordance with FTC guidelines and local regulations. This includes adding appropriate disclosures to blog posts, social media posts, video descriptions, and email communications.

15. Intellectual Property

HEHE.studio Labs grants a limited license to use approved marketing materials. All Pinpasta and HEHE.studio trademarks, logos, and content remain our property. Custom marketing materials must be approved before use. This license terminates with the affiliate relationship.

16. Term and Termination

  • Agreement continues until terminated by either party
  • Either party may terminate with 30 days written notice
  • HEHE.studio Labs may terminate immediately for violation of terms
  • Upon termination, affiliate must cease all promotional activities

17. Liability and Indemnification

  • Program provided "as is" without warranties
  • Affiliates indemnify HEHE.studio Labs against claims arising from their promotional activities
  • Liability limited to unpaid commissions owed
  • Neither party liable for indirect or consequential damages

18. Confidentiality

Affiliates agree to keep confidential any non-public information about HEHE.studio Labs' business, including commission rates, conversion data, and strategic plans.

19. Modifications

HEHE.studio Labs reserves the right to modify these terms with 30 days notice to active affiliates. Continued participation constitutes acceptance of modified terms.

20. Governing Law

This Agreement is governed by the laws of Poland, with disputes resolved in Polish courts.
